Article 1 : Purpose
The purpose of these rules is to guarantee the proper operation of the public passenger transport service managed by the agglomeration in its capacity as the main transport organising authority, by ensuring that the conditions of safety, health and tranquillity required for the exercise of this mission are respected.
It is intended to apply to all users (passengers and students) who use the network on a regular or occasional basis.
Article 2 : Conditions of access to the network
To gain access to the vehicle, the user must present a valid ticket issued directly to the driver when boarding:
- In one of the sales points of the Cap'bus network
- The driver on board the buses
All tickets must be accounted for as far as "technically" possible.
The user must be able to present his or her ticket valid for the entire journey in the event of a check or have the money needed to purchase a single ticket.
In the event of loss of a ticket, a temporary pass issued by Cap' bus, which is responsible for renewing the ticket, may be accepted on an exceptional basis on the network for a period that cannot exceed 15 consecutive days.
Cap' bus in charge of renewing the ticket, may be accepted on an exceptional basis on the network for a period not exceeding 15 consecutive days.
If the rider is unable to present his or her ticket or a temporary pass to the driver, access to the vehicle cannot be authorized without payment of a single ticket.
However, the driver may exceptionally authorize the user to board the vehicle depending on the context (passage of the next vehicle far away, excessive heat, etc.) and on the user's particular status (person with reduced mobility, pregnant woman, woman with young children, etc.). Please note: these two conditions do not apply to minors traveling alone, who must be taken in charge.
However, this type of incident should be recorded immediately.
Article 3 : Ascent and descent of the vehicles
The vehicles are boarded from the front and disembarked from the rear after the user has clearly informed the driver by an automated system or hand gesture.
For safety reasons and for the proper organization of transportation, users may only get on or off the vehicle at stops identified and marked on each route of the network. All "convenience" stops are strictly prohibited.
Getting on and off the vehicle must be done with respect for everyone, especially persons with reduced mobility, after the vehicle has come to a complete stop.
The driver is authorized to objectively refuse access to the vehicle to a passenger whose behavior clearly poses a risk of disturbing public order (drunkenness, excessive aggressiveness, various forms of violence, etc.)
When a passenger displays one of these behaviors during the trip, the driver may encourage him or her to get off at the next stop on the route, with the exception of minors.
However, this type of incident should be recorded immediately.
Article 4 : Vehicle Accessibility
Bags, luggage and briefcases must be placed in such a way as not to obstruct the aisle and access to exits, particularly the emergency door.
Animals accepted on the network (small animals or dogs for the disabled) must be kept on a leash and muzzled and must not interfere with the seating and circulation of other passengers.
In all cases, the owners remain solely responsible for any incident that occurs to their animal or to third parties due to the fault of their animal.
The driver may refuse access to the vehicle if the vehicle's capacity (seating and standing room) is exceeded, although priority access must always be given to minors traveling alone.
In the event that it is not possible to pick up the animal, the driver must immediately inform his superiors by telephone and wait for the arrival of the relays on site.
Article 5 : list of mandatory rules of conduct on the transmission system
Cap'bus and scale of penalties for non-compliance
All Cap'bus drivers are authorized to ensure that the rules set out below are respected on site and to report any breach of these rules.
Groupe n° 1 :
- Failure to present or repeated absence of the ticket (more than 3 times during the same quarter)
- Talking to the driver without a valid reason
- Undermining the peace and quiet of the driver and other passengers in any way (untimely movements, shouting, jostling, noise or odor pollution, etc.)
- Not respecting the rules of hygiene and basic dress code
- Touching the handles, locks or any other opening device of the doors and emergency exits before the vehicle stops
Basic sanction: warning letter by registered letter with acknowledgement of receipt, sanction in case of repeated offence or aggravating voluntary fact: exclusion during 8 working days (except Sundays and public holidays) Possibility of penal pursuit: no (except compulsory wearing of the belt)
Groupe n° 2 :
- Refusal to show the ticket
- Blocking the departure of the vehicle or the access of other users
- Throwing objects
- Collecting or selling anything in the vehicles
- Using any alarm or security device without reason
Basic sanction: exclusion for 7 working days (excluding Sundays and public holidays). Sanction in case of repeated offence or wilful aggravating act: exclusion for 15 working days (excluding Sundays and public holidays). Possibility of criminal prosecution: yes
Groupe n° 3 :
- Verbal aggression towards the driver or a third party
- Consumption or incitement to consumption of alcohol, tobacco or
- illegal substances in the vehicle
- Use of lighters or matches in the vehicle
- Theft or damage to the vehicle's safety equipment (hammer,fire extinguisher...)
Basic sanction: 15 working days exclusion (excluding Sundays and public holidays). Sanction in case of recurrence: exclusion of one month. Possibility of criminal prosecution: yes
Groupe n° 4 :
- Vandalism of vehicles (interior and exterior) as well as street furniture associated with the exercise of the public transportation mission (stop signs and bus shelters)
- Falsification and/or fraudulent use of tickets
Basic sanction: one month exclusion. Sanction in case of repeated offence: permanent exclusion. Possibility of criminal prosecution: yes
Groupe n° 5 :
- Ambiguous" behaviour towards minors
- Unarmed physical aggression towards a third party of age or minor
- Behavior that seriously endangers the safety of other users or the driver
Basic sanction: immediate exclusion of one month with filing of a complaint at the nearest gendarmerie. Sanction in case of recurrence or aggravating voluntary act : permanent exclusion. Possibility of criminal prosecution: yes
Groupe n° 6 :
- Sexual assault on minors
- Assault with a weapon against a third party of age or minor
Basic sanction: immediate and definitive exclusion with filing of a complaint at the nearest gendarmerie. Possibility of criminal prosecution: yes
During a period of exclusion, the user will in no case be authorized to access vehicles of the network.
As far as schoolchildren are concerned, it will be up to the families to ensure the transportation of their children by their own means during the period of exclusion.
In the event of a criminal offence, Cap'bus may refer the matter to the legal authorities for prosecution. This referral does not preclude the application of administrative sanctions or the reimbursement of expenses incurred in the case of vandalism by the transport service provider.
Additional general remark : any act of vandalism or deterioration of equipment involves, in addition to the sanctions defined above, the financial responsibility of the user if he/she is of age, or of his/her legal representative if he/she is a minor, with respect to the transport provider.
Ø The warnings are pronounced by the agents of the Cap'bus network after information (Hérault Méditerranée agglomeration community) and the advisory opinion of any secondary organizing authorities concerned (region, department)
Repeat offenses, temporary exclusions and permanent exclusions are pronounced by the Cap'bus network controllers, after interviewing the user in the framework of a joint disciplinary committee composed of elected officials and agents of the agglomeration, representatives of the transport company and the driving personnel, and if necessary, representatives of the secondary organizing authorities and parents of students.
Any case not provided for in these rules and duly notified in writing to the organizing authority by the authority by the carrier may give rise to the drafting of a rider.
Article 6 : consignation des incidents
All incidents must be recorded in a single logbook made available to the driver by his hierarchy.
This report must imperatively mention :
- The precise details of the offender
- The nature of the fault committed
- The details of the problem encountered
Article 7 : Information sur les sanctions prononcées
The following will be informed, as appropriate, of the measure taken against the Cap'bus user
- The President of the Communauté d'Agglomération Hérault Méditerranée
- The Mayor of the commune where the user lives
- The secondary organizing authority that issued the transport ticket if necessary
- The social services that may be concerned

Article 9 : Application and enforcement of this by-law
The delegatee, the services of the Communauté d'Agglomération Hérault Méditerranée and the secondary organizing authorities are responsible for ensuring compliance with these regulations.
Article 10 : validity period
These rules are valid until their next modification and shall be brought to the attention of all users of the network by any means.
